Tatiana Toader, a candidate for the post of chief prosecutor of the National Anticorruption Directorate (DNA), said on Tuesday that magistrates do not require additional safeguards under criminal law beyond those afforded to other citizens.

During her interview before the Justice Ministry's commission, Toader backed restoring the DNA's jurisdiction over offences committed by magistrates, arguing that it is necessary to ensure equality before the law for all citizens, potrivit Agerpres.

"I do not believe that magistrates should enjoy additional protections under criminal law beyond the constitutional safeguards already in place for all citizens. Introducing further mechanisms would only deepen public mistrust in a prosecution system that applies equally to everyone. I understand the debate, and my fellow prosecutors expressed, during consultations, their support for restoring jurisdiction to the National Anticorruption Directorate, which indicates the profession's confidence in the DNA. I would not want any future legislative change in this regard to be interpreted as evidence that the mechanism established by Law 49/2022 was ineffective or that the fight against corruption within the judiciary has failed," Toader said.

She noted that last year, out of 5,500 cases handled by the DNA, only eight involved indications of corruption offences committed by magistrates.

"The judiciary is not a corrupt system, and I do not say this as a slogan. I will offer some statistical elements from the activity of the National Anticorruption Directorate that may help us reflect. For example, in 2025, out of 5,500 cases we handled, only eight involved indications of corruption offences committed by magistrates, which required referral to the prosecutors' offices attached to the courts of appeal and to the Prosecutor's Office attached to the High Court of Cassation and Justice. This is a figure worth considering in the context of this analysis, alongside the total number of cases and the overall number of magistrates in Romania," Tatiana Toader said.
