The Minister of Investments and European Projects, Dragos Pîslaru, will have discussions with European officials in the coming hours, after the magistrates' pension reform was declared constitutional, and, after the promulgation of the law by President Nicusor Dan, will ask the European Commission to re-analyze the request for payment 3 of the National Recovery and Resilience Plan.
"Justice has been done: the CCR declared the cutting of special pensions of magistrates constitutional.(...) The referral of the High Court of Cassation and Justice was rejected by the Constitutional Court with 6 votes out of 9. It is a major change in one of the most sensitive chapters of the reform and a turning point in the discussion about equity and sustainability in the pension system in Romania. In the coming hours, I will have discussions with European officials regarding this evolution of the approval of the law by the CCR. Once promulgated by President Nicusor Dan, we will finally be able to demonstrate the implementation of the reform undertaken by Romania within the PNRR. This will then be officially transmitted to the European Commission of this evidence, for which we will request the reanalysis of payment request no. 3. Even in the context of the regrettable delay of over two months after "Before the November 28 deadline, I will make all diplomatic, formal and informal efforts to try to save the situation of the special pension milestone and the 231 million euros, non-refundable European money," the minister wrote on his Facebook page.
He emphasized that, "for the first time in history", the Government led by Ilie Bolojan succeeded in cutting special pensions and mentioned the main provisions of the normative act: the retirement age gradually increases to 65 years, over a transition period of 15 years; the pension will be, in principle, 55% of the average gross allowances from the last 60 months, but no more than 70% of the last net allowance; early retirement is possible only with a minimum of 35 years of service and with a penalty of 2% per year until reaching the standard age of 65.
The Constitutional Court of Romania rejected on Wednesday the notification of the High Court of Cassation and Justice regarding the new project of the Bologna Government regarding the reform of magistrates' pensions and established that the normative act is constitutional, CCR officials told AGERPRES. The decision was taken with six votes to reject the notification of the High Court of Cassation and Justice and three to admit it.
