The Government approved, on Thursday, a decision amending the implementing rules of Law No. 200/2006 on the Guarantee Fund for the Payment of Wage Claims, in order to strengthen the protection of employees in situations where their employers have financial difficulties.
According to a press release from the executive branch, the approved regulatory act clarifies the periods for which salary claims can be granted, differentiated according to the type of employer and the applicable procedure (insolvency or preventive composition), as well as the method of calculating the periods covered by the fund, including exceptions in the case of full payment of salaries by the employer.
The government decision also clarifies the mandatory social contributions owed by employees of employers in a state of insolvency or in a preventive arrangement that are borne by the Guarantee Fund, namely the social insurance contribution and the one for social health insurance, the cited source specifies.
Also, the regulatory act updates the administrative procedures for the payment of salary claims, as well as the necessary documents.
"Law no. 200/2006 regulates the establishment and use of the Guarantee Fund for the payment of wage claims, a social protection mechanism intended for employees whose wage rights can no longer be paid by their employers, as a result of the opening of insolvency or composition proceedings, and introduces the category of economic agents of strategic interest established by government decision. The legislative framework was recently amended and completed by Government Emergency Ordinance no. 6/2026," the executive mentioned.
