Judges at Bucharest Tribunal disagree on Georgescu's case; a dissenting panel will be formed

Two judges from the Bucharest Tribunal panel, which is handling the legionary propaganda case of Călin Georgescu, failed to agree on Friday whether to start the trial on the merits or send the case back to the Prosecutor's Office.

The trial is in the preliminary chamber and on December 9, 2025, the 1st District Court decided that the trial on the merits can begin, after a magistrate determined that the evidence collected by prosecutors is legal.

Georgescu's lawyers appealed the decision to the Bucharest Court, where they requested that the file be sent back to the General Prosecutor's Office.

The two judges on the court panel failed, at Friday's deadline, to agree on a solution: either give the green light to start the trial on the merits, or send the file to the prosecutors.

Consequently, a dissenting panel will be formed, with the entry of a third judge, with a deadline of Monday, February 9.

"Based on art. 394 paragraph 5 of the Code of Civil Procedure, it is found that a divergence has arisen, and the trial of the case will resume in the divergence panel. It sets a deadline of 09.02.2026, 11:00, for when the appellant will be summoned and the chosen lawyer will be notified. Pronounced in the session in the council chamber and made available to the parties and the prosecutor through the court registry, today, 06.02.2026" - is the court's decision.

Georgescu was sent to trial on July 2, 2025 by the General Prosecutor's Office, under judicial control, being accused of publicly promoting the cult of persons guilty of committing crimes of genocide, crimes against humanity and war crimes, as well as of publicly promoting fascist, legionary, racist or xenophobic ideas, conceptions or doctrines, in a continuous form (five material acts).

The indictment states that, between June 16, 2020 and May 16, 2025, Călin Georgescu repeatedly promoted in public, through various means, fascist, legionary and xenophobic ideas, conceptions and doctrines, such as:

* the mass mobilization of the nation for its regeneration and rebirth through palingenesis - the creation of the new man, under the dome of Orthodox Christian mysticism, including by implicitly accepting the use of violent means;

* the need for the emergence of a charismatic, predestined and authoritarian leader, able to put this process into operation;

* excessive glorification of the historical past in contrast to the present situation, characterized by the profound damage to the dignity of the national community and its placement in the sphere of victim status, as a result of the actions of enemies of the state, artificially identified as external state actors;

* populist ultranationalism based on a Christian mythical core;

* the cult of Marshal Ion Antonescu, a person definitively convicted of war crimes, praising his person, presenting him as a national hero and reproducing, through imitation, almost to the point of identity, not only his words, but also his gestures and tone of voice and performing the legionary salute during a speech given in front of a crowd of protesters against the restrictions imposed in the context of the coronavirus pandemic, in University Square in Bucharest, on October 2, 2021.

"Specifically, it was noted that the defendant has affirmed over time, in interviews, statements or online posts, his pro-legionary ideological consistency/links in the non-legionary environment with promoters of the non-legionary ideology, with the aim of producing a change in perception regarding the historical framing of the Legionary Movement in an attempt to normalize and revitalize legionaryism and the historical figures connected to this ideology, meaning that he made several statements of a laudatory/praiseworthy nature towards Corneliu Zelea Codreanu, Ion Antonescu, Ion Mota," the prosecutors claim.
