DIICOT officials have confirmed that a public institution has filed a complaint about the publication of the protocol by Valcov, alleging violation of Article 303 of the Criminal Code, which references the disclosure of state secret information.
Judicial sources told AGERPRES that the institution that submitted the complaint is SRI.
In this case a criminal case has been opened regarding the misdeed.
On August 24, the Attorney General's Office announced having opened a criminal case in connection with the publication by Valcov of that protocol and started criminal prosecution of negligence in keeping state secret information, which is criminalised under Article 305 in the Criminal Code.
The case was opened after Darius Valcov posted on his Facebook page a protocol of collaboration between SRI and the Attorney General's Office regarding "co-operation for the fulfilment of their tasks" concluded in December 2016.
On December 8, 2016, the Prosecutor's Office with the Supreme Court of Justice concluded two protocols with the Romanian Intelligence Service: a co-operation protocol establishing the actual conditions of access to the non-secret technical systems of the National Centre for Interception of Communications and a protocol on co-operation between the Romanian Intelligence Service and the prosecutor's office for the fulfilment of their duties according to the law - classified state secret, secret level.
Regarding the second protocol, the Attorney General's Office stated that on March 22, 2018, it initiated the steps for declassification and asked SRI for agreement to do so.
"The object of the Protocol references co-operation on detecting crimes against national security, terrorist offences and crimes committed by the military personnel of the Romanian Intelligence Service, notifying the prosecutor's office about the crimes detected by SRI and communication of information in accordance with the provisions of Law 50/1991 on the national security of Romania, of Law 14/1992 on the organisation and functioning of SRI and of the Code of Criminal Procedure. The protocol expired on March 13, 2017, by mutual agreement of the parties involved. At the same time, the Attorney General's Office asked the Romanian Intelligence Service to communicate whether or not it maintains the classified nature of the document, "explains the Attorney General's Office.

The Romanian Intelligence Service (SRI) has informed the Directorate for Investigating Organised Crime and Terror (DIICOT) regarding the release of a protocol of collaboration between it and the Attorney General's Office by Darius Valcov, advisor to Prime Minister Viorica Dancila, judicial sources told AGERPRES on Monday.
