The Government adopted on Wednesday a draft law amending and supplementing Law 286/2009 on the Criminal Code, Law 135/2010 on the Criminal Procedure Code, as well as other normative acts, reads a Government release issued for AGERPRES.
According to the cited source, the bill was drafted by the Ministry of Justice and aims at modifying and completing the criminal legislation to bring it into line with the provisions of the Constitution, as interpreted through 13 Constitutional Court decisions.
According to the Government, specific interventions are also proposed on Law 682/2002 on witness protection, Law 192/2006 on mediation and organization of mediator profession and Law 254/2013 on serving sentences and prison measures ordered by judicial bodies during the trial.
"The main regulations in the criminal legislation on which changes are proposed are those related to how to apply the more favorable criminal law, the moment by which the conciliation of the parties in the criminal proceeding can intervene, rejections prosecutors, the definition of the continued offenses, some of traffic offenses on public roads, the regulation of absolute nullity cases, the revision of final court rulings, the regulation of the intimate visit for inmates," the press release said.
As far as the Code of Penal Procedure is concerned, amendments are proposed that will be in line with the provisions of eight Constitutional Court decisions.
The draft law will be submitted for debate and adoption to Parliament.
